Reports out of Sangamon County indicate that Judge Raylene Grischow has vacated the decisions by Clay County Circuit Court Judge Michael McHaney in the lawsuit brought by 109th District State Representative Darren Bailey against Governor J.B. Pritzger. The suit alledged that the governor exceeded his authority by extending his original state emergency order covering COVID-19. In her written ruling, the judge stated that McHaney was wrong in stating that state law prohibited the governor from issuing extended emergency orders and that he also errored in ruling that his decision extended to all Illinois residents. She also denied a petition filed by Bailey in October charging the governor with indirect civil contempt. The reports also say that no decision has been made by Bailey as to if the ruling will be appealed and that that it could come at the beginning of the the new year.
