A Democratic lawmaker has proposed legislation that would create the Right to Garden Act.
5th District State Representative Sonya Harper said her legislation would allow the State or a unit of local government to regulate gardens on residential property unless the statute or regulation has the practical effect of precluding gardens on residential property entirely.
She said the law does limit home rule powers and would take effect immediately. The proposed legislation, which was filed on February 6th, has three democrats and one republican co-sponsor so far.
